The Kenai Peninsula Borough plat committee granted preliminary approval to multiple subdivision plats and approved several exceptions to borough subdivision and setback codes during a routine meeting. The committee approved the consent agenda (including Gateway Subdivision and Hope Lake Subdivision) and voted unanimously on motions to grant exceptions and preliminary approvals for Fields Brown, Peterson Forest, Sanders Estate, Dayton and Kelly Acres.
Staff told the committee that the Fields Brown preliminary plat would subdivide a 46.5-acre parcel into eight tracts and that an existing house eave encroaches 1.1 and 3.1 feet into a newly created 20-foot building setback. Staff recommended granting an exception to KPB 20.30.240 (building setbacks) and adding notes to the final plat documenting the exception. A committee motion to grant the exception passed by unanimous voice roll call (England, Morgan, Venuti, Whitney recorded yes).
On Peterson Forest (a 13.02-acre parcel proposed to be split into roughly 1.295 and 11.724-acre lots), staff recommended carrying forward a prior exception to KPB 20.30.170 (blocklength) and granting an exception to KPB 20.40 (soils/wastewater) for Lot 5A if supported by the engineer’s sign-off. The committee approved preliminary plat status and the soils/wastewater exception, again by unanimous vote.
Sanders Estate and Dayton subdivisions were presented with site-specific notes: Sanders Estate includes partial dedications and a recorded public road easement for Sunshine Drive with staff recommending a termination document be recorded with the final plat; Dayton involved reconfiguration of three parcels and a flood-hazard notice placed on the plat notes. In both cases staff recommended exceptions where applicable and the committee approved the preliminary plats and the requested exceptions unanimously.
At Kelly Acres (an 8.77-acre tract proposed to split into two tracts), staff identified a detached garage built in 1982 that appears to encroach into a newly required 20-foot setback and recommended allowing an exception (KPB 20.30.240) while requiring plat notes showing encroachment dimensions. Staff also recommended granting a soils-report exception for the smaller lot (KPB 20.40.040) if supporting documentation is present. The committee approved the preliminary plat and both exceptions by unanimous vote.
Throughout the meeting staff consistently recommended placing notes on any final plat indicating exceptions granted and the date of the plat committee action. Committee roll-call votes were recorded as England, Morgan, Venuti and Whitney voting yes on the recorded motions. No public testimony opposed the plats during the hearings.
The meeting record shows staff-driven findings tied to the KPB code standards for each exception and direction to surveyors to work with utility providers where utility easements or access permissions were relevant. The committee adjourned after approving all items on the agenda.
