Shenandoah adopts ordinance to regulate private detention‑pond design and maintenance

The Shenandoah City Council voted Feb. 25 to adopt an ordinance establishing city authority to regulate the design, retention and maintenance of private detention ponds. Staff framed the ordinance as a tool to reduce flooding risk after a pump failure at a commercial detention pond on David Memorial.
"A good detention pond, well maintained, will help [mitigate] flooding in the city," a staff member told the council while introducing the ordinance and outlining enforcement points. That staff member said the Home Depot detention pond on David Memorial had experienced pump failures and inadequate maintenance, which contributed to localized flooding and limited the city’s ability to respond because the pond is privately owned.
Under the ordinance, maintenance requirements will apply to both existing and new private detention ponds. Council members asked whether older, preexisting ponds would be grandfathered for design; the city attorney clarified that existing ponds remain grandfathered on design but not on the maintenance obligations meant to ensure functionality.
The ordinance includes a penalty provision for violations and directs the city to hold private owners accountable for upkeep. Council voted to adopt the ordinance on a motion that carried by voice vote.
Staff emphasized enforcement is intended to reduce flood risk and ensure private pond operators meet ongoing maintenance obligations rather than impose new design requirements retroactively without notice.
