The Town of Sunset Beach council adopted an amendment to its Unified Development Ordinance on July 14 that allows certain pre‑existing single‑family homes in the MR‑3 zoning district to expand under defined conditions.
Planning staff explained the amendment would permit a single‑family home that was vested prior to the UDO adoption in September 2023 to enlarge provided any enlargement does not create new nonconformities (for example causing a new front or rear setback violation) and does not exceed 50% of the home's square footage. The Planning Board had reviewed the change and recommended approval.
A resident asked for clarification that the expansion would not encroach into an existing five‑foot setback; staff and council confirmed the amendment allows expansion "equal to your existing home" so long as it does not produce additional nonconformities. Council moved, recorded a consistency statement with the 2017 Town of Sunset Beach land use plan, and approved the ordinance by voice vote.
