Property owner Joseph (Joe) Fitzpatrick presented extensive materials to the council alleging that concentrated upstream drainage and infrastructure changes have caused incision and ongoing erosion that materially reduced his buildable area since he purchased two parcels in 2021. Fitzpatrick said his packet includes LIDAR points and surveys that show about 0.22 acres of land loss and contends the city’s drainage routing concentrates flows that now threaten the parcel’s buildability.
Fitzpatrick proposed two remedies: the city purchase an easement and pay $460,000 for an easement while the city would harden the branch’s banks and restore the site, or the city purchase the property outright for $1,275,000. Councilmembers questioned the chronology of alterations, whether culverts and headwalls predated the recent purchase, and if maintenance or prior capital work could have contributed to the condition. Staff said there were no drainage capital projects in the area since 2018 and promised to check public records and maintenance logs.
Council discussed options including seeking grants for remediation or negotiating an easement in exchange for remediation work, but several members expressed hesitancy about paying the proposed sums without more evidence and clarified that any use of public funds for private property would require an easement and careful public-interest justification.
No formal action was taken. Staff agreed to meet with Fitzpatrick, review the documentation he submitted, evaluate potential grant and easement strategies and report back to the council; councilmembers discussed the option of asking the owner to offer an easement in exchange for remediation work as a cooperative approach.
