Mark and Gail Kasprzak addressed the council during public comment to report that their home at 6433 33rd Court — owned for 40 years and annexed into Greenacres — was assigned an MXD (mixed‑use development) zoning designation that, they said, does not allow a single‑family residence and rendered their property nonconforming.
The Kasprzaks said they had a buyer under contract who lost financing four days before closing after an appraisal identified the MXD zoning; they described trying seven lenders without success and said lenders would not approve FHA, conventional or VA loans because of the zoning and limitations on repairs after disaster damage. “We spent months getting our house ready to sell... Then 4 days before the closing... the deal fell through,” they told the council, asking staff to work with their consultant (Kevin McGinley of Land Research Management Inc.) to find an accommodation that would allow the sale to proceed.
City Manager Miss McHugh responded that the zoning change occurred in 2014, that notices were sent (she cited March 2014 notices and adoption of Ordinance 2014‑02), and that staff would follow up with the assistant director of Development and Neighborhood Services to explore solutions. McHugh said staff would contact the Kasprzaks to discuss possible accommodations.
The council did not take formal action during the meeting but the Kasprzaks asked the mayor and council to direct staff to work with their consultant; staff indicated a follow‑up would occur.
