The Beaver City Planning and Zoning Commission approved a residents request to install an open-sided carport that would encroach on the usual side-yard setback, after staff measurements and neighbor support were presented.
The applicant, identified in the transcript as the resident (Speaker 1), told the commission she wanted a 15-by-20-foot, open-sided carport on the east/southeast side of her property "just to protect our cars" from leaves and birds and that a contractor had told her online she may not need a permit. "I'm proposing to put a carport on the east side east kind of Southeast, I guess," she said.
Staff and commissioners reviewed zoning setbacks aloud: the transcript records a 20-foot front (street) setback, a 5-foot rear setback and an 8-foot side setback. Planning staff (Speaker 3) used the commissions mapping tool and reported an interim measurement of about "11.71 feet from the corner of your shed to that property line," noting that fence lines do not always match property lines and that the mapping measurement is not 100% accurate. Staff cautioned that meeting the property-line setback is the determinative factor, not the location of a fence.
The commission discussed whether to set a specific numeric concession or to grant a conditional-use allowance; commissioners noted the planning commission may permit a smaller setback (the transcript indicates the commission has authority up to a zero-foot setback). The applicant confirmed the structure would be open-sided, would not be a garage or require a new foundation and would be sited on gravel adjacent to an existing picket fence.
The transcript records Committee member (Speaker 4) moving to grant the setback/allow installation of the carport and a second on the record; the commission chair then called for the question and the motion passed with vocal "ayes" recorded in the transcript. After the vote, staff explained the administrative next steps: the approval will be typed, signed by the city manager (referred to in the transcript as Taylor), and given to the applicant as her documentation to proceed.
The meeting record shows neighbor support: staff noted correspondence from the applicants daughter and from neighbor Linda Perez indicating no objection. Commissioners also discussed enforcement practices, saying code enforcement generally operates on a complaint basis.
The commission then moved on to routine items, briefly noting upcoming subdivision proposals and code revisions related to water acquisition rates, and adjourned.
The commission did not provide a full roll-call vote in the transcript; an official signed record will provide the formal tally and any conditions attached to the approval.
