Melbourne Beach orders fence repairs at 207 Flamingo Lane after code hearing

The Town of Melbourne Beach ordered the owner of 207 Flamingo Lane to repair a deteriorating fence within 10 days or face a $100-per-day fine after a code enforcement hearing on Sept. 10, 2025.
Jennifer Kerr, the town's finance manager, testified that inspectors first visited the property on June 2, 2025, and found "the fence still showing it being propped up and boards falling off, the slats coming out." Kerr said the next-door neighbor, identified in testimony as Miss Lam, had been propping the fence from her own yard and that the property previously presented an unsafe pool condition that the neighbor had mitigated.
Kerr told the hearing the property had been posted in July, was reposted on Aug. 14 with the rescheduled Sept. 10 hearing date, and that notices were mailed first-class to the registered agent and property owner. She said a warning and citation were issued July 9, 2025, but that a follow-up inspection on Sept. 9 showed the fence remained in disrepair.
With no one present to contest the town's evidence, the hearing officer found the property in violation of Town code 7a-53, subsection 5 (maintenance). The hearing officer ordered the homeowner to complete repairs within 10 days, directed town staff to inspect compliance on the 10th day, assessed administrative costs of $274.36 and ordered that a $100-per-day fine begin on day 11 for each day the fence remains in violation.
The chair marked the town's notice as Exhibit A and the cost breakdown as Exhibit B and closed the hearing. The meeting adjourned at 3:10 p.m.
