The Stephens County Planning Commission voted on Sept. 3 to grant a conditional-use permit and a related variance that will allow a barber to operate from an existing office building on a 4.31-acre property while the principal residence is under construction, subject to conditions and a 12-month review.
Staff told commissioners the county ordinance (Section 59-14-11) allows a home-based barbershop limited to two patrons at a time as a conditional use but that home occupations are normally incidental and secondary to residential use. Because there is "no present residential use on-site," staff recommended a temporary variance while the property owner completes building permits: "Permitting requires that work must substantially begin within 6 months and continue positively through the inspection process ... the conditional use be approved for 12 months with follow-up scheduled at the 12 month mark," staff said.
Property owner Zeigaleb, who said he runs a business called Zeigarbara, told the commission he planned to move the barber operation to the site while a two-bedroom, two-bath house is built. He said moving would reduce his monthly overhead and help him finance construction: "I have to work with my finances and the only way I'd be able to get approved for the home construction is if I clear a couple of thousand dollars a month," he said. He also said business would be appointment-based and estimated modest daily patronage.
Commissioners discussed limiting the use to the existing office structure, confirming appointment-based operations, and ensuring permitting and inspections progress. A motion to approve staff recommendations, including conditional use and a 12-month variance pending construction progress, was made and seconded; the commission approved the motion by voice vote.
The conditional use will expire at 12 months if permitting and construction have not substantially progressed; staff directed follow-up at the 12-month mark to determine whether an extension or expiration is appropriate.
