RSAC discusses legislative fix for road service-area annexations, weighs district model

The Assembly Road Service Area Committee met Feb. 9 to review outcomes from a recent joint work session with the administration and to discuss a proposed legislative priority aimed at changing how new neighborhoods join existing road service areas.

Ms. Curry, a service-area commissioner, told the committee she wants a standardized packet for neighborhoods that petition to join a service area, saying, "So to me there has to be, enough information that we can get out to our service area members and say, this is a great fit for us." She outlined specific items commissioners should receive: road-condition assessments, population and tax base estimates, road age and known problems, and distance from commissioners' existing routes.

Administration staff described current procedures for bidding and contractor evaluation. Michael Bradley (administration staff) said large bid packages are already grouped geographically after renewal cycles and that "we have our standard specifications" plus local "special conditions" for individual service areas. He noted staff can include equipment requirements in specifications but warned against restricting bidders and said response expectations are contract-based (he cited a typical response window of about 24 hours).

A committee member described an annexation the staff identified in which two properties that rely on service-area roads had been omitted from the service area and were later added after an annexation vote. The member argued the state law's two-vote requirement (annexing and annexed area votes) can prevent properties that have no other road access from being added, and suggested a legislative fix so such properties could be added automatically. "We basically gain funding because we gain the tax on those properties that we aren't currently gaining," the member said.

Mayor [Mayor] and staff said a resolution creating a legislative priority to pursue statutory changes will appear on the assembly agenda this week; staff emphasized the proposal is prospective and would not alter existing service-area boundaries or taxation for the current 103 service areas. "It would not be impacting any of the current service areas in place at all," the mayor said, describing the priority as authorization for staff and the lobbyist to work on code changes.

Members debated longer-term options, including a district model that would consolidate many service areas into larger district jurisdictions. Supporters said test pilots in areas such as Farmers Loop had worked in the past, while skeptics pointed to terrain differences, varied mill rates and contractor capacity as obstacles. Bradley warned an immediate switch to a few large districts could strain staffing and contractor management but said an organic, gradual approach could make resource needs predictable.

Committee members asked staff for written proposals and for historical data on past annexation attempts and outcomes. No formal actions or votes were taken by RSAC on the legislative priority at the Feb. 9 meeting; staff noted the legislative-priority resolution is scheduled on the assembly consent agenda for consideration by the full assembly.

The committee closed with a request for more detail and the next RSAC meeting was announced; the committee adjourned at 7:05 p.m.
