The Kosciusko County Area Plan Commission voted to forward a favorable recommendation to the county commissioners to vacate a 16-foot platted alley north of Lot 14 in the plat of Lakeview Park.
Steve Snyder, representing the petitioner Pierce 778 LLC, said a recent survey showed the platted alley runs through the owner’s garage and that much of the adjacent alley system has already been vacated over time. "The GIS is incorrect, and the survey is correct," Snyder said, explaining the alley's recorded alignment and the practical access problems it created for the property owner.
A commissioner moved to vacate the easement; the motion was seconded and passed by voice vote. Matt Sandy said the commission will forward a favorable recommendation for the county commissioners' March 27 public hearing at 9:00 a.m.
Snyder told the commission he had advised the petitioner to pursue a limited vacation that resolves the garage encroachment and allow other adjacent owners to seek additional vacations if they choose, since title searches and easements vary across the block.
