York County approves fund transfers, authorizes bank pledge pooling as officials warn of budget pressure from delayed legal billings

York County commissioners on May 16 approved a series of budget transfers to correct miscoding, confirmed an inheritance-fund adjustment already completed and authorized the county treasurer to allow pledged securities at Midwest Bank to roll into a Nebraska Bankers Association pool that will cover amounts exceeding FDIC insurance limits.
The treasurer and chair described several corrective transfers, including a prior inheritance switch of $1,250,000 completed before the fiscal year and multiple smaller transfers to build cash reserves for emergency management, state institutions and county attorney accounts. Officials said the pool arrangement simplifies administration when county balances temporarily exceed the $250,000 FDIC-insured threshold.
The board also reviewed vendor claims and noted a $43,000 payment to an attorney for multiple clients and multiple years of billings. Deputy County Attorney Chris Johnson told commissioners the county has little discretion to refuse these payments once a judge approves them: "This is close to an unfunded mandate," Johnson said, explaining that statute requires the county to pay approved indigent-defense bills and that some juvenile cases may linger for years, generating large retroactive claims. He said the county attorney's office had reviewed and signed the claims as necessary.
Commissioners discussed options including continued outreach to judges, raising the issue with the Nebraska Association of Counties and exploring possible legislative fixes to reduce fiscal strain from delayed billing. Separately, the board approved a resolution releasing specific pledged-securities CUSIP numbers and allowing the treasurer to participate in the pooled pledge program with Midwest Bank.
All motions on transfers, the pledged-securities pool and vendor claims were moved, seconded and approved by roll-call vote during the meeting.
