York County commissioners approve four planning-and-zoning reappointments, defer decision on contested nominee

York County commissioners on Oct. 17 approved reappointments to the county planning-and-zoning board but delayed action on one contested nominee after members of the public raised potential conflicts related to an industrial solar project.

Jean Jackson, speaking for the group Our Voices Count, asked whether current planning-and-zoning members would be reappointed to three-year terms and raised concern that a nominee identified as Luke might have ties to parties promoting a proposed industrial solar farm in East Township. "Our voices count believes this is a problem," Jackson said, urging the board to consider conflict-of-interest risks before confirming new appointments.

In response, Commissioners questioned whether the nomination warranted delaying all appointments or whether the concerns should be addressed separately. A representative for Omaha Public Power District, Dustin Marble, clarified that an earlier public comment misidentified another individual’s employer: "Mister Panko, he is not an employee of OPPD," Marble said.

After discussion the board moved to reappoint four members — Roger Morris, Erica Vaughn, Carl Heine and Chad Hirschfeld — by resolution and to follow up with the nominee Luke at a later meeting. The chair said staff would reach out to Luke to invite him to the next meeting for questions; commissioners emphasized that the planning-and-zoning board’s recommendations ultimately come before the county board, which retains authority to accept, reject or rewrite those recommendations.

The meeting also included several routine but formal actions. The board approved payroll and vendor claims — including an added $18 claim from the public defender for Culligan Water — by roll call. County staff described a state-funded courtroom audiovisual upgrade and presented an inventory and a "possession and responsibility" acceptance; the board approved signing the inventory so the county assumes ownership of the upgraded equipment and can reallocate replaced items within county departments.

Separately, the board approved a one-year memorandum of understanding with a local crisis center intended to address questions raised in a prior audit about county funding. Transcripts of the meeting refer to the provider alternately as "Hope Crisis" and "Oak Crisis Center"; county staff and the county attorney prepared the MOU and a signed copy from the provider was on file before the board voted to authorize the county’s signature and to fund the budgeted amount for the year.

Board members also discussed other items including a posted notice of intent to request release of construction funds related to a 4 Corners project, committee reports on road maintenance and fleet vehicles, and pending requests for county contributions to a rural workforce housing grant. The board briefly convened as the Board of Equalization, approved minutes and adopted the equalization agenda, and approved an exemption application for a 2020 Toyota Camry associated with York University as recommended by the county treasurer.

The meeting recessed for board equalization business and later entered executive session at 9:37 a.m. to discuss personnel matters with legal counsel and HR present. The board did not take public action on the personnel item during the session.

What’s next: the board indicated it will contact the contested nominee to invite him to the next regular meeting for questions and possible clarification before any appointment decision is made.
