The Lincoln Town Council on Oct. 21 approved an amended tax-stabilization and building-permit phasing agreement for the Walker Laws adaptive-reuse project, permitting the developer to spread high building-permit fees over multiple annual payments tied to its financing schedule.
Attorney Joelle Rosette told the council the project originally proposed pre-COVID as an $18 million development has grown to a roughly $50 million adaptive-reuse project. Building-permit fees and a fire-fee payment exceeded $200,000; the proffered schedule breaks the bill into approximately $70,345 annual payments with the final balance due before a certificate of occupancy is issued.
Council members asked whether phasing the town fees would have fiscal impact or create an undesirable precedent. The finance director said permit fees are project-specific and not general revenue, and that the town's budgeting conservatively anticipates such receipts. Administration and the solicitor said the change does not alter the tax-stabilization portion of the agreement and that the plan is required to align with lender timing and historic tax-credit requirements.
A council member raised concerns that spreading fees could cost the town interest income; administration and colleagues said the payment schedule is structured to align with construction draws and financing and does not relieve the developer of paying all fees before occupancy. The council approved the motion to accept the amended tax-stabilization agreement and the building-permit phasing by voice vote.
Next steps: the phasing agreement will be memorialized in the town's records and payments will be scheduled according to the agreement; the town will withhold a certificate of occupancy until fees are paid in full.
