Staff reported the developer delayed one large payment by about seven months after billing, and council members said that pattern undermines the town’s willingness to rework the maintenance agreement on the town’s dime.
A staff member said the developer asked for terms that would permit longer invoice-review windows and less-frequent invoicing — requests that could create delays of up to 60–90 days before payment. "They paid us seven months after we billed them for the last big bill," the staff member said, describing the payment history that prompted caution about changing the agreement.
Council members said they did not want to spend significant town funds to draft changes that provide little benefit to Interlaken. The Chair recommended the town attorney send a consolidated list of requested edits to the developer’s attorney and return to the council with a single, balanced draft instead of paying the town to chase piecemeal changes.
No vote or formal amendment was adopted; staff and the town attorney will follow up with the developer’s counsel and present a revised draft when available.
