Assembly authorizes manager to negotiate water/sewer easement for Block 75 lots, amending alignment to avoid Pulling Creek

The Skagway Assembly on Oct. 16 authorized the borough manager to negotiate an easement that would allow the installation of private water and sewer lines to serve Block 75 Lots 4 and 5, an easement requested by applicant Robert Murphy. The assembly amended the authorization to prefer a 13th Avenue right‑of‑way alignment to avoid crossing Pulling Creek and passed the amended motion on a 5‑yes roll call.

Manager Dietz explained the process: the properties lack nearby water mains and the easement would allow a private line to reach the lots while the municipality would provide a connection to the property line. Dietz said planning and zoning recommended the easement, the proposed private installer is Northpointe Construction, and final easement terms will return to the borough attorney and assembly for approval.

Assembly member Woodell emphasized environmental concerns: "Pulling Creek is an important water source in our community," she said, noting a 2005 assessment that placed the creek on an impaired‑waters list for heavy‑metal contamination and that the Skagway Traditional Council manages a recovery plan. Woodell moved the amendment preferring the 13th Avenue right‑of‑way to avoid crossing the creek; the motion carried.

The resolution authorizes the manager to negotiate the easement but requires any finalized easement agreement to come back to the assembly for final approval. The action does not itself change land ownership or authorize construction; it authorizes negotiation of terms and conditions.
