Clermont council adopts annexation and construction-time rule; introduces police pension and flagpole changes

The City of Clermont council on Tuesday adopted final approval for a 2.35-acre annexation, approved a clarified time limit for commencing construction, and introduced ordinances to amend the police officers’ retirement plan and the city’s land-development code on flagpoles.
Nick Gonzales, development services, told the council staff recommended approval of the annexation request for the parcel at 13550 Granville Ave., and the ordinance (2025-021) passed on final reading with a 5–0 vote. "The property is approximately 2.35 acres," Gonzales said, adding it meets statutory requirements for annexation and can be served by city utilities.
The council also adopted Ordinance 2025-006 to add measurable time limits for conditional-use permits, including a requirement that ‘‘physical construction would at a minimum include a completed and approved building inspection’’ within the two-year approval window, Planning and Development Director Kurt Hensel said. After a public comment asking whether nonprofits could get additional time, the council voted 5–0 on final reading to adopt the ordinance.
On first reading the council introduced Ordinance 2025-033, a set of amendments to the police officers’ retirement plan covering contributions, pre-retirement death benefits, minimum distributions and supplemental components. No public speakers addressed that item and the introduction carried 5–0.
The council also moved forward with an amendment to the land-development code (Ordinance 2025-032) addressing flagpole height and exemptions for poles displaying only the American flag. Debate centered on appropriate maximum heights, lighting for large flags and constitutional limits on content-based restrictions. Legal counsel cautioned that courts have struck down ordinances that single out types of flags, and recommended language to reduce legal risk.
