Commission rejects owner's appeal and continues dilapidation proceedings for 601 East Elm

City code staff summarized a history of minimum-housing cases at the address dating to 2008 and said the property repeatedly returned to the file for protective repairs and roof and porch work. The current case opened Jan. 14, 2026, staff said, and inspection photos show holes in the roof and light visible through a porch area. The code official told the commission he posted the property and that officers felt unsafe entering the porch to take detailed photographs.
Owner Calvin (self-identified during the hearing) disputed the city’s jurisdiction and asserted pending district-court filings and a claim that the property is his homestead. He said the neighborhood was damaged by recent storms and disputed the timeline of enforcement. Mr. Calvin also alleged personal and financial harm and warned of lawsuits; staff and the city attorney’s representative said this proceeding was the administrative appeal regarding dilapidation and not the district-court venue.
After hearing testimony from staff and the owner, a commissioner moved to reject the appeal and continue with the dilapidation process; a second was recorded and the motion passed 6-0.
What happens next: The commission sustained staff’s dilapidation determination and will proceed with the administrative steps required by city code; the owner indicated he may pursue district-court appeals.
