At a March 3 work session the Market City Planning Commission reviewed proposed clarifying edits to the land development code intended to remove unintended triggers for planning review and to ensure consistent permit requirements.
Staff said some current LDC language results in small exterior or interior changes being routed to planning review unintentionally and proposed clearer exemptions for minor alterations. “We are trying to clean it up so that demolition or diminution of a multifamily residential or nonresidential building does not require [planning review] unless it meets the thresholds,” a staff member explained. Commissioners probed how common downsizing or partial demolition requests are and whether thresholds are appropriately calibrated.
One commissioner cited numeric thresholds in the draft chart: additions or alterations that exceed a 16,000 square-foot footprint or 40,000 square feet of gross floor area would require site-plan review; staff said those thresholds are aimed at larger commercial or multifamily projects and that the intent is to reserve site-plan review for large-scale work while allowing staff-level or minor reviews for smaller projects.
Staff also flagged a discrepancy in parking rules: Figure 28 indicates 'no minimum' for office and retail parking while Figure 29 lists occupancy rates for those uses, a conflict that could inadvertently impose requirements where none should exist. Staff proposed reconciling the figures and updating the table language to remove confusion.
Commissioners discussed condominium and minor‑site-plan procedures and asked staff to ensure review levels matched project scale and to return with clarified language. No formal vote was taken on any LDC amendment at the meeting; staff will prepare revised text and bring it back for additional review.
