The Mount Clemens City Commission authorized the interim city manager to execute a five-year extension of the Metro Act right-of-way permit with MCI Metro Access Transmission Services and Verizon Access Transmission Services, allowing those companies to continue construction, installation and maintenance of telecommunications facilities in the city right-of-way from 07/18/2022 through 07/17/2027.
City Manager Shipman summarized the extension and told commissioners the extension mirrors the terms of the existing agreement. A staff or commissioner speaker noted state law enacted in 2002 constrains municipalities from imposing fees or requirements on telecommunication providers beyond those specified in the Metro Act. The meeting record shows the statute provides for a one-time $500 permit fee and authorizes maintenance fees that are paid to the state, with an annual distribution formula that may provide a small share back to municipalities based on linear feet of right-of-way.
A commissioner asked if there were caps or other limits; staff said the extension is standard and largely the same as prior agreements. Commissioners approved the extension by roll call.
The motion authorizes the interim city manager to sign the extension; staff said the city will verify whether the state distribution of maintenance fees has in practice reached the city and will follow up as needed.
