County staff introduced the item and noted the board previously set an enforcement deadline tied to the 11/22/2024 date. Austin Perry, speaking as legal counsel for the property, told the board that written discovery is complete, depositions are being scheduled and the parties have not provided counteroffers. "We have not received any counter offers from the other side," Perry said, and added that the litigation is progressing on a standard trial calendar and he did not anticipate requesting discovery extensions at this time.
Commissioners indicated they were in a difficult position balancing enforcement with allowing the judicial process to proceed; one commissioner asked that the litigation be allowed to play out before the board removes the enforcement action. A motion to extend enforcement for six months from the 11/22/2024 date was made, seconded and the board recorded the motion as carried.
The board directed staff and counsel to continue monitoring the case and to report substantive developments back to the board before the extension expires. The meeting moved on to other agenda items after the vote.
