Rules Committee advances bill to clarify data-sharing for medical cannabis cards

The Rules Committee voted unanimously to advance SB 395, a bill that now focuses on improving communication between the Department of Public Health and the state medical board regarding medical cannabis card records. Senator Kirkpatrick, who presented the measure, said much of the bill’s original content already exists in statute and the remaining provision addresses information sharing between the two agencies.

The bill’s sponsor told the committee that “the cannabis cards are produced by the Department of Public Health,” and that the application process is handled there while enforcement falls to the medical board. Senator Kelser questioned why language in earlier drafts — intended to require a physician to have an established doctor–patient relationship before certifying a cardholder — was removed. Senator Kirkpatrick replied that the requirement already exists in state code and offered to provide the citation.

Committee members emphasized enforcement concerns. The sponsor and other members cited examples suggesting weak oversight, including a referenced case of an out-of-state physician issuing a large number of cards. A committee member said this points to the need for stronger enforcement, not necessarily new substantive statutory requirements.

A motion to “do pass” was made and seconded, and the chair called the voice vote. The motion carried unanimously, advancing SB 395 from the Rules Committee.

The bill now moves to the next stage of the legislative process per the committee’s calendar.
