The Town of Tazewell council held the first reading Jan. 13 of an ordinance to vacate a portion of Bishop Street and set conditions for the vacated parcel.
Town attorney (S8) outlined the ordinance provisions, including that the vacated portion would merge with adjoining parcels and retain existing utility easements. The attorney said the commissioner of revenue would determine the assessed value of the vacated portion and proposed a payment timetable for the acquiring property owners. The ordinance identifies the parcel number (O948704000A) for recordation.
The attorney told the council the statute provides a 60-day right of appeal and cautioned the council about recording and appeal timing: “Statute provides for a 60 day right of appeal,” S8 said. The attorney also noted state statute and town code provisions that govern vacating public streets and the mechanics for payment and recording.
Council members asked clarifying questions about past closures and recording practice. The council carried the first reading and set the item for the next meeting’s second reading; staff said the council could adopt at second reading after the 60‑day timeframe and required payments were satisfied.
Because the action was at first reading, no final recordation was completed at the meeting; staff said owners and the public have the statutory appeal period to object before the town records a deed.
