Oro Valley adopts zoning-code changes to align with new state rules and add height-permit review for schools and parks

The Oro Valley Town Council on Jan. 14 adopted ordinance O26-01 to revise town code and zoning regulations to conform with recently enacted state law changes and to add some local policy adjustments.
Principal Planner Michael Spade told the council the ordinance falls into three main categories: (1) compliance with new state statutory requirements that shift many non-discretionary, code-compliant development reviews to administrative approval; (2) non-substantive code cleanups and corrections; and (3) a local change to require conditional-use permits for building-height increases in the private schools and parks/open-space zoning districts so that council, rather than the Planning & Zoning Commission alone, approves such increases.
Spade explained process details the code change preserves: final plats that include public dedications would still be taken to council for acceptance before administrative approval of the plat; appeals would remain available to 'aggrieved' parties meeting defined thresholds (property owners or owners within 300 feet demonstrating a demonstrable error); and some exceptions with specific code criteria could be administratively approved while exceptions with greater potential impact would remain before council.
Councilmembers commended staff for the work and for preserving citizen involvement where the code allowed. A motion to approve the ordinance carried unanimously by voice vote (recorded 6–0).
