Mister Martin told the council the site was previously abated under contract last summer after extensive outdoor hoarding and garbage removal; since that time new accumulation outside and very poor interior conditions have been observed. "We did have a company come in under contract, clean the property, and bring it into compliance last summer... In the time frame since last summer, garbage and other items are starting to accumulate once again," Martin said.
Council members asked whether the dwelling is occupied and whether public health should be involved; Martin confirmed the dwelling is occupied and recommended the health department be asked to evaluate interior conditions as part of the response. The request seeks authority for the city’s legal team to pursue injunction and abatement through circuit court if necessary.
Next steps: the council will set a public hearing on the regular meeting agenda for the formal nuisance determination and staff plans to involve legal and public health as appropriate.
