Committee subpoenas Marshals Service agreement; DOC director did not appear

The Committee on Public Safety, Emergency Management and Guam National Guard told witnesses March 9 that it served a subpoena on March 5 to Department of Corrections Director Berdaglio under 2 GCA §3102 for the intergovernmental service agreement between the government of Guam, DOC and the U.S. Marshals Service dated Oct. 1, 2019.
"That document was not given to this committee," the chair said, noting the director did not attend the hearing. The committee said it will take additional action under its statute concerning the subpoena duces tecum and asked DOC leadership to produce the requested materials.
Because Director Berdaglio failed to attend and did not submit the requested documents, the committee recessed the oversight hearing and said it will reconvene next month after confirming room availability and providing courtesy notices to senators, DOC and local media.
The committee did not vote on any matter at the hearing; senators asked DOC to provide follow-up documentation and updates on outstanding contraband cases, staffing data and the status of the Marshals Service agreement.
