Rail authority approves easement for driveway across rail-trail corridor

The Pine County Rail Authority approved an easement allowing the Cannonburg family to maintain a driveway crossing the county's former rail corridor in Brook Park.
Staff told the authority the legal description had been reviewed by the county surveyor and counsel and the parcel had been fully surveyed before the request was presented. A staff member said, "We do have a request from the Cannonburgs, for an easement across the trail," and pointed out the easement language clarifies the property owner's maintenance responsibilities. Authority members discussed signage and public-safety implications and noted the corridor currently has limited public use.
Staff said the easement follows the form of prior approvals and does not include language requiring a stop sign; if a roadway crossing permit is necessary the property owner would need to seek approval from MnDOT and follow that process. The authority moved, seconded and approved the easement request without further amendment.
The county will record the easement and the legal description in county land records; property owners will be responsible for maintaining the driveway and any crossing improvements required by MnDOT.
