Roosevelt County commissioners approved a road-use agreement with Blackwater Solar Center, LLC that specifies which county roads the developer will use and maintain during construction and operations.
County counsel and the developer presented a final version of the agreement that adds an exhibit map showing the roads planned for use. Commissioners said the agreement can only obligate county-controlled roads; sections of the map that cross private property do not change private owners’ rights and would require separate agreements between the developer and landowners. Commissioners asked staff to make road-use commitments contingent on necessary landowner agreements where private roads are implicated.
The motion to approve the road-use agreement passed unanimously. Counsel said final execution will include the map and signature blocks as presented and reiterated that the agreement imposes road-maintenance obligations on the developer for county roads included in the exhibit.
