Council tables Montalcino Estates Phase 4 after resident raises fence, access concerns in Phase 3

The Town Council voted to table consideration of Montalcino Estates Phase 4 until December 1 after a resident urged the council to withhold action until Phase 3 obligations were complete.
Planning staff presented the subdivision site plan for Phase 4 and associated exceptions: a house pad benching exception for 1-acre lots (staff supported this with conditions), a lot-to-lot drainage easement for lots bisected by an existing creek, slope-impact exceptions (staff quantified impacted acres), a tree-removal request (ECC recommended approval of removal for seven specimen trees and denial for four), and a parks board recommendation to accept cash-in-lieu in the amount of $22,680 and park development fees totaling $24,984 in lieu of required parkland dedication.
Cindy Clark, a resident at 8704 Baltus Raul Drive, told council she had experienced contractors entering her yard without advance notice during Phase 3 fencing work; she said the developer had left part of the fence unfinished, taken down existing fencing, and not completed agreed work that, by the timetable she had, should have been done by July 2025. Clark asked that phase 4 be denied until Phase 3 met its obligations.
Darren Andrews (engineer for McAdams) said he had tried to reach the contractor and the developer and acknowledged outstanding issues; he said the infrastructure/development permit for Phase 3 must be closed out before permit close-out and that, in normal practice, required fencing adjacent to neighboring lots is installed before the infrastructure permit closes. Council members said they did not have enough information about Phase 3 performance and suggested tabling Phase 4 so the developer or Lennar representative can appear and answer outstanding questions. The item was tabled to the Dec. 1 meeting by unanimous vote.
