The Flower Mound Town Council voted to approve the final-phase site plan for Montalcino Estates Phase 4, including certain slope and house-pad exceptions, a tree-removal permit (with four specimen trees excluded as recommended by the Environmental Conservation Commission), and related parkland/cash-in-lieu and park development fees.
Planning staff outlined the project as an 18-lot Cross Timbers Conservation Development on the north end of town and described requested exceptions for house pad benching, lot-to-lot drainage, and slope impacts. Staff recommended approval with standard conditions, including a private drainage easement and compliance with the town's design criteria manual. The parks board recommended accepting $22,680 in cash-in-lieu and $24,984 in park development fees.
Jake, the town arborist, summarized the ECC's recommendation to deny removal of four specimen post oaks (tree IDs 1184, 1206, 1217, 1282) while approving other requested trees. In open public comment, resident Cindy Clark described persistent fence and adjacency issues along Baltusrol Drive and said Lennar representatives had committed to contacting affected homeowners, clearing deadfall, and installing replacement fencing.
Roderick Middlebrook, a project manager for the developer, told the council the developer has started property-owner outreach, retained a contractor to clear common-line debris, and plans to install approximately 2,000 feet of wrought-iron fencing at a pace of roughly 200 feet per day (weather permitting). Jack Dawson of Centurion American noted one lot in foreclosure and said that could affect part of the timeline.
Council members asked for several stipulations; a motion approved K2 (site plan) "as presented" with staff stipulations and an added condition that retaining walls not exceed 5 feet, and then approved K3 (tree removal) excluding the four trees the ECC recommended denying. K4 was approved as proposed. All motions passed by unanimous vote.
