Board OKs variance to allow side‑yard pool at 6402 Johnson Chapel Road West

The Brentwood Board of Zoning Appeals approved a variance request to allow a pool to be located in the side yard at 6402 Johnson Chapel Road West during its Sept. 15 meeting.

Planning staff (Allison) told the board that Terry Sales requested the variance because extreme topographic conditions and the orientation of the existing house make locating a pool in the rear buildable area impractical. Allison said staff determined the three statutory variance criteria were met — unusual lot shape/topography, practical difficulties from strict application of the code, and no detriment to the public good — and recommended approval.

Allison described the property as lying within the Hillside Protection Overlay District, with slopes in the 33%–61% range; she said the lot was created in 1996 and later revised in 2005. Applicant Terry Sales confirmed the lot is wooded and "in excess of 6 acres." Allison reported no written correspondence had been received about the request.

After the presentation and no public comment, Todd Spillane moved to approve the variance and Eric Hook seconded; the board approved the motion by voice vote.
