At Item 3a the Chair introduced a review of zoning board composition, procedures, powers and duties and asked whether any members still needed the required training.
A City of Denton staff member described the training as a review of how the board is entitled under state law to hear zoning variances, sign variances and appeals of staff decisions and what options the board has when considering each case. "The training is more just a personal review of the board, how you all are able by state law, and then your primary functions, and hearing zoning variances, sign variances, and, appeals of staff decisions," the staff member said, and offered to meet individually: "If you would like, I'm just happy to meet with you and run through that as well."
The Chair emphasized the board's quasi-judicial function: "So it's quasi judicial. So our we don't make recommendations for them to go to counsel. We make decisions." Members agreed that one remaining member would review the material online ahead of a December hearing. Staff described the item as a work session and said no formal vote was required.
The discussion clarified that the board issues decisions (rather than only making recommendations) in quasi-judicial matters and that staff will provide training materials and one-on-one briefings for any member who requests them.
