The Kearney City Planning Commission approved a rezoning and associated preliminary and final plats to consolidate two parcels at 119 Central Avenue into the Buckshot Addition and rezone them to a C3 designation.
Craig Bennett of Miller Associates told the commission the application combines two tracks into one platted lot, confines historical blanket electrical easements (a 115‑kV transmission line) with MPPD, and provides recorded instrument numbers for those confined easements. Bennett said utilities, a 16‑inch water main and a 15‑inch sanitary trunk main, are in place to serve development. He also said the applicant withdrew a requested future‑land‑use (FLU) amendment; staff (Melissa) confirmed the FLU amendment was withdrawn and recommended approval of the rezoning, preliminary and final plats as consistent with the comprehensive plan and existing infrastructure.
Commissioners received two letters from a neighboring property owner alleging a boundary issue. City attorney Mike Tai told the commission that boundary disputes are matters for the courts and that the planning commission’s duty is to evaluate the zoning and plat application against zoning and planning factors: "This is not the forum where a boundary dispute gets resolved... Your obligation here is to review the application that's before you," Tai said. He added that, if a court later changes a boundary, the city could revisit plats or zoning as necessary.
Bennett said the MPPD easement release covered both parcels and was recorded; he presented certified warranty deeds showing title and title insurance to Buckshot Farms LLP. With staff recommendation and no public testimony on the record beyond submitted letters, the commission moved, seconded and approved the rezoning and plats.
Ending: The commission’s approvals are recommendations where applicable and will be reflected in city records; letters alleging boundary issues were entered into the record and, per legal counsel, may be addressed in court if the party pursues litigation.
