Hardee County’s county attorney presented a preliminary draft reorganizing the Board of County Commissioners’ policies and procedures and walked commissioners through proposed changes to sections on governance, meetings, committees, legislation and conduct.
The draft reorganization would: clarify meeting types and notice requirements; standardize agenda order and offer a recommended reading of legislation; set rules for remote participation (including limits on voting when a member cannot fully view an item); create a public participation attachment with default three‑minute public comment periods and narrowly defined circumstances for extensions (for representatives or group spokespeople); add rules on executive sessions and cybersecurity presentations; and include a suggested orientation and reorganization meeting process for newly elected commissioners.
“People often start asking questions before staff finishes their presentation,” the county attorney said, explaining the recommended order of presentations, public comment and board discussion to ensure full information is on the record prior to motions.
Commissioners debated public comment parameters: several supported keeping a three‑minute default but allowing limited extensions (for representatives or group spokespeople), while the county attorney cautioned about appearing to discriminate on speech content and said she will add specific parameters to the public participation attachment. The draft also calls for distributing complete agendas to board members, the clerk and attorney at least five business days before meetings when practicable.
Next steps: the county attorney will refine the draft, add the public participation attachment and bring additional sections back for review. Commissioners said they will provide feedback to shape final language and asked staff to ensure the rules align with statutory requirements.
