After a staff presentation, the council amended a proposed zoning change on swimming pools, hot tubs and spas to target permanent aquatic facilities over 144 square feet. Planning staff explained the amendment would add a clear, size-based threshold to the municipal code and provide definitions and permit guidance for permanent above-ground pools, decks and related structures.
Alderman (voice 13) moved the amendment: "any in ground or above ground permanent swimming pool, hot tub, or spa over a 144 square feet require a building permit; those under 144 square feet do not require a permit," and the motion was seconded and adopted for first reading. The council explicitly left the second reading in place so members could review finalized language before final adoption; the roll-call outcome on the amended first reading recorded six ayes and two nays.
Staff said seasonal pools that are taken down each year remain exempt; permanent above-ground pools and associated decking typically require permits because of electrical, decking and safety components. The amended ordinance will return for a second reading with the updated chart and definitions.
