Nags Head adopts UDO fix to clarify Sound Side event permitting

The Nags Head Board of Commissioners on Nov. 5 adopted a text amendment to the Unified Development Ordinance that narrows the "designated public event site" definition to the Sound Side Event Site and aligns permitting deadlines between the UDO and Chapter 4.
"These changes do not add any new requirements. They're just to make the process more consistent," said Kelly Wyatt, planning and development director, while presenting staff's recommendation and noting that the Planning Board had voted unanimously to recommend approval.
Wyatt told the board the amendment removes ambiguity that had grown over time about whether the designated-public-event language applied to other properties. The change also moves the hours-of-operation provisions into the UDO to avoid duplication with Chapter 4.
Planning staff emphasized the edits were largely housekeeping to make permitting "clearer and more predictable" for both event organizers and town reviewers. The board asked clarifying questions and heard that the amendment would not alter current activities at the Sound Side Event Site by itself; any substantive program changes would come through separate Chapter 4 language under consideration.
Commissioner Sanders moved to adopt the UDO amendment with the accompanying statement of consistency; the motion was seconded and passed by voice vote.
The amendment was adopted as presented. Mayor and staff said the board will separately consider a broader Chapter 4 replacement that could change timelines, fees and other event standards.
