Council approves package of LDR changes aimed at clarifying nonconforming development and parking rules

The Town Council unanimously directed staff Nov. 17 to draft ordinances for six targeted Land Development Regulation (LDR) amendments addressing nonconforming development, parking standards and administrative adjustments.
Planning staff described amendments intended to (1) exempt modest improvements to nonconforming structures from certain facade and setback triggers, (2) clarify the definition of structural support and when replacement triggers full LDR compliance, (3) exempt modest window and door relocation from triggering nonconforming rules, and (4-6) add administrative authority for limited parking-stall and drive-aisle relaxations and the procedures the planning director would use.
Planning Director Paul Anthony told council that one objective is to stop cases where applicants effectively "rebuild a house within a house" to avoid compliance; staff said the clarification around structural support is intended to close that loophole while the other amendments add limited flexibility for existing, functional improvements.
Councilors debated larger policy concerns about whether the amendments would encourage demolition or, conversely, help preserve older commercial buildings and support small businesses. Mayor Jorgensen and others urged caution but supported the package as a predictable, balanced fix that received a unanimous planning-commission recommendation.
Councilor Sperry moved to approve the LDR text amendments (P25-1176) as presented and to direct staff to prepare ordinances for first reading. The motion passed unanimously.
