The Nags Head Planning Board unanimously approved a text amendment Tuesday that aligns the town's designated public event-site rules with the existing crowd-gathering permit process and pulls outdated language about "outdoor amusements" into the Unified Development Ordinance.
Kelly White, a planning staff member, told the board the amendment narrows its scope to two changes: make the designated public event site (the Soundside event site) follow the same timeline and application process used for other crowd gatherings, and modernize outdated chapter 4 definitions to avoid duplication of code language. White said the section's existing 14-day supplemental application requirement was rarely followed and that staff proposes striking it in favor of the standard crowd-gathering procedures.
White explained examples that motivated the change, including events that were approved with limited details and later created offshoot gatherings or unanticipated impacts in other parts of town. "Sometimes those things aren't represented factually on the paperwork that we're given, and they're larger than proposed," she said, describing instances in which an application underestimated expected attendance and the event later required more resources than permitted.
The planning staff also reiterated that while the presented amendment focuses on alignment and definitions, a broader rewrite of chapter 4 is underway and will be considered separately. White described a proposed tiered review structure for future revisions, for example calibrating review requirements by expected attendance (e.g., up to 100 people, 250—50, 500+), but emphasized that the current action was limited to the alignment.
When asked, White confirmed the current trigger for the crowd-gathering permit is 100 people. She said staff wants to keep a midnight-to-7 a.m. hours-of-operation restriction for places of amusement and ensure that required review steps remain timely for the town's public-safety and public-works departments.
Committee member speaker 4 moved to approve the amendment as submitted and speaker 9 seconded. The board approved the motion by voice vote; the chair recorded all in favor and no opposition.
