The Nags Head Board of Commissioners voted to adopt a text amendment to the Unified Development Ordinance that clarifies the Sound Side Event Site is the only location classified as the town's "designated public event site" and aligns permitting timelines between the UDO and Chapter 4.
Planning and Development Director Kelly Wyatt told the board the change "does not add any new requirements. They're just to make the process more consistent" and said the Planning Board had unanimously recommended approval at its Sept. 16 meeting. Wyatt also noted the proposal removes outdated, duplicated definitions from Chapter 4 and moves the hours-of-operation standard into the UDO's use table to reduce redundancy.
The board asked brief clarifying questions, heard no public comments during the hearing, and approved the amendment and a statement of consistency on a motion and voice vote. The ordinance change was presented as a cleanup and alignment measure intended to make permitting for large events at the Sound Side Event Site more predictable for organizers and staff.
Because two specific provisions in the UDO required formal legislative action, staff included a statement of consistency for the board's consideration. Wyatt said the amendment "clarify[ies] that the Sound Side Event Site is the only location classified as the designated public event site," and emphasized the drafting goal was procedural clarity.
Next steps: the amendment will be incorporated into the UDO text as adopted, and staff will continue coordinating with event organizers to implement the clarified timeline and application references.
