Trustees approve leases, development agreements, traffic ordinances and schedule closed session
Summary
At its Feb. 2 meeting the Village Board approved ground leases with Old Falls Village and the Menomonee Falls Historical Society, multiple development agreements and traffic ordinances, agreed to reimbursements related to a sanitary interceptor covered by impact fees, and voted to convene in closed session under state statute for personnel and litigation matters.
The Menomonee Falls Village Board used its Feb. 2 meeting to approve several contracts and ordinances and to move into closed session for personnel and legal matters.
Under agenda item 7a the board approved a ground lease between the Village and the Friends of Old Falls Village after the president recused himself because of his ties to the organizations. The board also approved a ground lease with the Menomonee Falls Historical Society (item 7b) after extended discussion about contract language clarifying maintenance responsibilities and about a recent $11,000 roof replacement the village paid in 2025; trustees requested clearer reimbursement language and an inventory of assets to protect village interests going forward. Village Manager Mark Critstero said the historic property is insured and emphasized that the village had stepped in to expedite work in 2025 as part of a capital plan.
Under item 8 the board approved multiple development agreements and a package of traffic ordinances (items 8b'i) in a single motion; that package includes stop, yield and speed-limit signs to be paid for by developers in the listed subdivisions. The board approved a development agreement for Evergreen Fields Phase 7 (16 residential lots) under which the developer installs public infrastructure which is then dedicated to the village.
The board also approved a development agreement with Fox River Falls LLC for a sanitary sewer interceptor project (project 176). Officials said the village's portion of the reimbursement is $1,561,270 and that impact fees will cover the village's share.
Trustees approved an amendment to the water purchase agreement with the City of Milwaukee to clarify map lines and coverage, a cleanup of historic mapping issues rather than an expansion of service.
Finally, the board unanimously voted to convene in closed session under Wisconsin Statute 19.85(1)(c) and (g) for the village attorney performance review and to discuss legal strategy on pending litigation.
