Commission recommends vacation of Scenic Hills outlot, schedules public hearing for March 2

The Planning Commission voted to recommend that the village board declare an outlot in the Scenic Hills subdivision excess right‑of‑way and introduce a resolution to begin the vacation process, with a public hearing set for March 2, 2026.

Planner Amy Bennett said an adjacent property owner requested the vacation of an outlot that measures roughly 60 by 210 feet and would be split between two lots. She showed the commission a map and explained staff supports introduction of the vacation request; the matter will go to the village board for introduction and then a public hearing will be published and held on March 2.

Commissioners questioned the legal status and purpose of the parcel. One commissioner said the survey labels the area as a "drainage easement" while staff noted some subdivision outlots are recorded as private drainage easements rather than village easements. Engineering staff stated that no new village drainage easement was being required for the parcel. Commissioners discussed possible consequences of vacating land that currently functions as drainage and suggested recording an explicit drainage easement if the village approves the vacation to preserve drainage function.

A commissioner moved that the planning commission recommend that the trustees declare the described outlot excess right‑of‑way and approve the attached resolution; the motion was seconded and passed with recorded aye votes. The public hearing will be scheduled for the village board meeting on March 2, 2026.

Next steps: the item will be introduced to the village board for referral and the public hearing process (class 3 notice) will proceed. Staff recommended recording or preserving drainage protections if the village ultimately vacates the parcel.
