Council Member Oderkirk asked whether an escalation clause could be added to prevent fees from lagging inflation; staff said the council could seek legal advice in closed session under Section 551.071 of the Texas Government Code and that the issue had been noted for a future amendment. Oderkirk indicated she was amenable to voting now and discussing the escalation later. The council voted to adopt the ordinance on second reading; the motion carried unanimously.
The ordinance also establishes expenditure requirements for previously collected funds and creates a trail credit to encourage developer participation in trail construction and connectivity.
