Town council approves surplus DPW equipment, Heritage Center agreement changes and interagency MOU

The town council approved a series of routine and programmatic items during its February meeting, including a resolution to surplus Public Works equipment, an amended rental agreement for the Heritage Center and an interagency phlebotomy memorandum of understanding.
The council adopted Resolution 05-20-26 to surplus a slide-in dump insert from the Department of Public Works that staff said is no longer compatible with the town's smaller replacement dump trucks. DPW staff described the unit as "a slide in type unit that slides into the back of a bed of a pickup truck and makes a regular pickup truck into a normal dump truck per se," and asked that the item be sold on GovDeals; the resolution passed by voice vote.
Councilors also voted to approve revisions to the Heritage Center rental agreement. A presenter argued the required certificate of liability insurance is "cumbersome" and that the existing $500 damage deposit is adequate for most incidents; council added language stating that "disorderly, unsafe, or illegal behavior is grounds for immediate termination of the event without refund" and that "damages not covered by the damage deposit are the responsibility of the renter," language the council said would allow the town to pursue small-claims remedies. The motion to remove the insurance requirement and adopt the new paragraphs passed by voice vote.
The council approved a phlebotomy memorandum of understanding between BPD and EPD as amended; members noted the version before the council omitted a more recent command-structure paragraph and agreed to pass the MOU with the suggested edits.
Separately, the town manager reported counsel for Rogers Group advised that a 99-year lease may not be permitted; the council voted to approve an amended lease reduced to a 50-year term and authorized the town's signatures as presented.
Other routine actions included approval of the minutes for Feb. 23, 2026, and motions to pay accounts payable and payroll vouchers. The meeting adjourned after staff and council provided updates on reorganization planning and community events.
