Summary
Planning staff said the measure would give the city local authority to protect dune and beach vegetation on public walkovers and crossovers—complementing state DEP CCCL rules—and the board recommended Ordinance O1‑2026 to City Council.
The Planning and Zoning Board voted to recommend Ordinance O1‑2026, a local measure to protect and enforce rules for beach dune systems and native vegetation on public property in the City of Cape Canaveral.
“This is specific to public property within the city, especially the beachfront vegetation and dune systems,” said Tony, a city staff member presenting the item, who said the ordinance would strengthen local code and enforcement mechanisms in addition to state Coastal Construction Control Line (CCCL) restrictions. Tony told the board the ordinance is intended to cover public walkovers and beach crossovers and would not apply to land owned by private condo associations.
The staff introduction said the measure limits maintenance to activities set out in a written maintenance plan approved by the city manager and that routine trimming by condo associations or private parties on private property would not be encompassed. Board members voiced support for protecting the city’s vegetative assets and for giving staff the ability to enforce protections on public property.
The board moved to recommend Ordinance O1‑2026 and voted in favor; all members present supported the recommendation.
The recommendation will be forwarded to City Council for consideration.
