County staff presented a draft county Subdivision Improvement Agreement (SIA) at the Jan. 14 Elbert County commissioners meeting and asked for one more delay to finalize internal processes before approval.
Lance (county staff/legal counsel) described the SIA as a statutory tool to ensure developers construct required subdivision improvements — roads, water, sewer, drainage — and to provide county inspections and security until construction is complete. "What this draft is, it's a letter of credit that is different from a bond," Lance said, explaining the operational difference: a bond typically requires litigation to access funds, whereas a letter of credit allows the county to draw funds when it determines a breach has occurred.
Lance told commissioners the form is intended to standardize negotiations and make the county’s expectations and procedures repeatable rather than renegotiated project-by-project. He recommended additional internal coordination with the county engineer, public works director and community development director before bringing the form to the next business meeting. Staff anticipates returning with the SIA at the next business meeting if no further changes are needed.
Commissioners asked clarifying questions about types of security and inspection processes. No final action was taken; staff will meet internally and bring a revised SIA back for formal consideration.
