Gallatin County commissioners approved a family-transfer exemption for Penny and Sydney Arthur on Sept. 2, allowing one parcel to be transferred to the applicants' daughter.
County Planning staff (Dawn McKay) entered a staff report and exhibits into the record and summarized that the proposed division would create two 5-acre parcels from an original 10-acre parcel in the residential suburban subdistrict of the Bozeman Area Zoning District and that the proposal met relevant sections of the county's subdivision regulations.
Applicant Penny Lou Arthur testified that the septic permit has been approved and a well is in place; she said the daughter (age 43) plans to build in the spring. "We're snowbirds...and sometimes we rent it out for 6 months," Arthur said describing current use; she told commissioners the family intends tract A to remain the residence of Sydney and Penny Arthur and tract B to be used for pasture until a residence is constructed.
Commissioners discussed whether the absence of fully documented building plans should delay approval but concluded the site preparations (septic, well) provided sufficient evidence that the transfer would result in the intended use and adopted the staff findings and the exemption on a voice vote.
