Bay Minette City Council approves rezoning, adopts planning fee schedule on first reading and appoints two to Planning Commission

The Bay Minette City Council on Dec. 19, 2022, approved a rezoning request, adopted a planning-and-zoning administrative fee schedule on first reading, approved payables totaling $542,371.01 and appointed two people to the Planning Commission.
The council convened at 6 p.m. at Bay Minette City Hall. Present were Mayor Robert A. Wills and Councilmembers Pete Sellers, Mike Phillips (mayor pro tempore), Matt Franklin, William Taylor and Shannon Clemmons. City staff listed in attendance included City Attorney Scotty Lewis, City Administrator and Finance Director Tammy Smith, City Clerk Rita Diedtrich, Community Relations Coordinator Tina Covington, City Planner Clair Dorough and Police Chief Al Tolbert.
On a motion by Councilmember Pete Sellers, seconded by Councilmember Matt Franklin, the council approved the consent agenda, which included minutes from the Dec. 5, 2022 council meeting and work session.
The council approved payables for Dec. 19, 2022, totaling $542,371.01. Mayor Pro Tempore Mike Phillips moved to approve the payables; Councilmember William Taylor seconded and the motion carried unanimously.
Mayor Wills recognized Police Chief Al Tolbert for presenting a program to the United Methodist Men's Group.
Mayor Wills recused himself and left the chambers for consideration of Ordinance 1017 (Case Z-22007), a rezoning request for property associated with the James Faulkner Jr. Irrevocable Trust (filed by Beverly Faulkner) to rezone the parcel from B-2 (business) to R-4 (residential). Mayor Pro Tempore Mike Phillips officiated the item. Councilmember Matt Franklin moved to approve Ordinance 1017 on second reading; Councilmember Pete Sellers seconded and the motion carried unanimously among those present.
The council then opened a public hearing on Ordinance 1018, the Planning and Zoning Administrative Fee Schedule. With no one present to speak, the public hearing was closed. Councilmember Matt Franklin moved to approve Ordinance 1018 on first reading; Councilmember William Taylor seconded and the motion carried unanimously.
Mayor Wills asked the council to approve Resolution 1222-06, appointing Todd Stewart and Hiram Templeton to the Planning Commission. Mayor Pro Tempore Mike Phillips moved for approval; Councilmember Matt Franklin seconded and the motion carried unanimously.
There were no council or citizen comments. Councilmember William Taylor moved to adjourn, Councilmember Shannon Clemmons seconded, and the motion carried. The minutes were attested by Mayor Robert A. "Bob" Wills and City Clerk Rita Diedtrich.
