State Board previews March-April agenda: dogs in microbreweries, petition policy revisions, fluoride and Lead and Copper Rule updates

Board staff presented previews and project updates for March and April during the Feb. 12 Environmental Health Committee meeting, identifying several items that could prompt future rulemaking or staff action.

Ash Noble and Molly Dinardo outlined March items including potential rulemaking on allowing dogs in microbreweries and an overview of the State Health Report prepared with contractor Sound Within. Chair Patty Hayes asked for a crosswalk of Board authority to support prioritization of rules and projects; Molly Dinardo acknowledged the request.

Shay Bauman described proposed revisions to the Board's Petition Policy, explaining staff selected the presented preliminary screening approach after consulting counsel. Chair Hayes asked whether screening would determine petition validity and whether alternative processes were considered; Shay said staff considered other options but selected the current approach.

For April, staff flagged concerns about unpermitted food vendors and reported federal developments on the Lead and Copper Rule Revisions that could affect Board rules; Shay said the Department may request the Board delegate rulemaking in April. Shay also noted the Board is working with the Department on naturally occurring fluoride levels and possible rule options arising from an ongoing science review; the oral health statement had not yet been discussed by the Health Promotions committee because web updates were not ready.

Shay also updated the Committee on Tacoma-Pierce County Health Department's DIY septic pilot and said staff would follow up with a prior public commenter to direct them to available information. The Committee set the next regular Board meeting for March 12, 2026.
