Special Initiatives Manager Cliff Bryson presented the staff and Planning & Zoning Commission recommendations and explained the site context and the public participation opportunities during the permit process. Applicants Dan and Jenny Phillips described the type of surface mining proposed on the parcels (APNs 403‑15‑001L, 403‑14‑004E and 403‑14‑004C) and answered council questions about operations.
Councilors expressed concerns about exterior setbacks, the site's topography and the adequacy of financial assurances for reclamation. After discussion, Councilor Robin Godwin moved to approve Resolution 2025‑1191 adopting the Use Permit with staff‑recommended conditions as described in Appendix A, and with an amendment setting setbacks at 30 feet for all exterior property lines unless the Town Manager approves a modification based on operational considerations. The motion also required a $5,000 surety bond as the financial assurance method. The motion passed on a roll‑call vote, 7‑0.
Town staff indicated the conditions in Appendix A and the amended setback and bond requirement will be included in the permit record and any final operating plan. The council's action included direction to staff and town legal counsel to ensure required reclamation assurances and operational conditions are documented prior to any expansion of on‑site work.
