Summary
Buffalo County adopted Resolution 2022-22 to correct the legal description of Dove Hill Road, accept a 66-foot strip by quitclaim deed, and authorize transfers to adjacent landowners to resolve record discrepancies before further development.
The Buffalo County Board of Commissioners on May 24 adopted Resolution 2022-22 to correct the official description of Dove Hill Road and to authorize quitclaim deed transfers intended to align legal records with the road’s physical location.
Deputy County Attorney Andrew Hoffmeister presented historical research from county road records dating to 1874 and 1875 that the board used to support the resolution. The action accepts by transfer a 66-foot-wide strip of land described by metes and bounds and authorizes the chairperson to transfer a described 66-foot-wide strip to named Peterson trusts or designees, subject to review and verification by the county attorney’s office.
The resolution states the exchange of land will not adversely affect public use of the road and that an accurate metes-and-bounds description is prudent before additional area development. The board voted to approve the resolution by roll call; the motion carried with members present voting Aye.
County staff will prepare quitclaim deeds and file the resolution with the Register of Deeds as authorized. The minutes include detailed metes-and-bounds language capturing the centerline and sideline descriptions that will be used in the deed documentation.
