Buffalo County approves subdivision, rezoning, cancels long-unused special-use permit and OKs sign permit

The Buffalo County Board of Commissioners on March 8 took several zoning and land-use actions, approving an administrative subdivision, adopting a zoning map amendment, cancelling a previously issued special-use permit for a painting and sandblasting operation, and approving a special-use permit to install signage for a retail agricultural facility.
Zoning Administrator Dennise Daniels and Deputy County Attorney Andrew Hoffmeister reviewed an administrative subdivision application filed by Mitch Humphrey on behalf of Seth J. Tschetter and T Period S Period Construction, Inc. The Board moved (Loeffelholz/Higgins) and adopted Resolution 2022-04 to approve the "T Period S Period Administrative Subdivision," finding the plat met Buffalo County's subdivision requirements.
The Board opened a public hearing on a 2006 special-use permit that had authorized a painting and sandblasting operation and, after Daniels reported the special use was no longer active and with no public opposition, moved (Loeffelholz/Higgins) to cancel Permit #2006-073 by adopting Resolution 2006-33A. The resolution states the permit was discontinued or abandoned for a period of at least 12 months and directs that a copy of the cancellation be filed against the subject property.
The Board also considered a zoning map amendment requested by Chad Dixon on behalf of Kohlscheen Farms to rezone approximately 10.34 acres from Agriculture (AG) to Agricultural-Residential (AGR). After reviewing Planning and Zoning Commission recommendations and finding no protests had been filed, the Board moved (Loeffelholz/Lynch) and approved Resolution 2022-05 to amend the zoning map.
Finally, Mark VanSlyke presented a special-use permit application for Simplot AB Retail Sub, Inc. (formerly Pinnacle Agriculture Distribution, Inc.) to install signage at a site in Gibbon. The Board moved (Maendele/Lynch) and approved Resolution 2022-06 for the sign permit, subject to compliance with applicable state and federal regulations and standard zoning conditions.
All four actions were approved by roll call votes with the seven commissioners voting in favor. Documents and resolutions referenced Buffalo County Zoning Regulations (including Section 3.02 and Section 6.2) and required that copies be filed with the Register of Deeds as appropriate.
The Board took no further zoning action at the March 8 meeting and moved on to citizens' forum and other agenda items.
